Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Smartify Expense platform ("Service"). By signing up or using the Service you agree to these Terms.
1. Accounts
You must provide accurate information, keep credentials secure, and are responsible for all activity under your account. Admins manage roles and permissions inside their organisation.
2. Subscriptions and billing
Plans (Basic, Super, Advanced, Enterprise) are billed monthly or annually. Annual plans receive a 30% discount. Fees are non-refundable except as set out in our Refund Policy. Taxes are added where applicable.
3. Acceptable use
You agree to use the Service in accordance with our Acceptable Use Policy and applicable laws.
4. Customer data
You retain all rights to data you upload. You grant Smartify a limited licence to process such data solely to provide and improve the Service, in line with the Privacy Policy and DPA.
5. AI features
OCR, copilot, and automation outputs are provided "as is". Always verify amounts, taxes, and policy compliance before approving an expense. Smartify is not liable for amounts approved on the basis of unreviewed AI output.
6. Intellectual property
Smartify retains all rights to the Service, brand, and underlying software. Feedback you submit may be used without restriction.
7. Confidentiality
Each party will protect the other's confidential information with reasonable care and use it only to perform under these Terms.
8. Warranties and disclaimers
The Service is provided on an "as available" basis. To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
Neither party is liable for indirect, incidental, or consequential damages. Smartify's aggregate liability is limited to fees paid in the 12 months preceding the claim.
10. Termination
Either party may terminate for material breach not cured within 30 days. On termination, you may export your data for 30 days, after which it is deleted in accordance with our retention schedule.
11. Governing law
These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of Dubai unless another forum is mandated by law.
